For the size they are no doubt hot, hottest.. not by my mouth.
Peppers have different effects in different areas of the mouth and from
person to person (has been my experience){Roy - note the disclaimer}.
Savana's and Chocolate Habs are my hottest experience.

Seems to me that {note! the me!} 
ToughLove has a good rep.. as a list member I can remember the Byron
posts.. (his opinions and others)
All the folks here speak whatever truth "they hold to be true"..
personally I'd like this issue to end, but no doubt Dave has been
wronged in whatever posts you mentioned him in, I can not recall anyone
EVER complaining about his product on the list and not getting
satisfaction (the best he could provide).
I am very glad to hear you had the backbone to send him the doc you
refered to so he also could refer to it.  
If Dave says he never sold to him (Byron), I take him for his word. I
recall Byron stating that the TOMATOES caused him large dollar amounts
of damage not peppers (my recall).
All-in-all ToughLove Co has been fine in all requests and any problem
solving needs here on the list.  
Here is the problem in a nutshell (no pun intended).
No matter who you are or what you do,, strong feels have been slapped
about one way and the other.. 
I would not pass judgement on info that I do not have first hand
knowledge about and post it to injury a party in what is an open area
(i'd ask Dave in a private post).  With all of the folks jumping in
about Dave and ToughLove's good rep I'd have my doubts about the source
of the info and/or my interpretation of said info.
Enough is enough.. end it.. one way or the other (you be the person
(man)) who ends it, not the one who stirs it.
