You're correct in stating that both the USDA AND Delta and Pine Land Co. were issued the original US patent as this technology was co-developed by D and P L plus the USDA. BUT the USDA has relinquished any claims on the `terminator' in exchange for a 5% "cut" of any & all net sales of `terminator' seeds. On May 11, 1998 Monsanto purchased the rights to the `terminator' from D&PL and now are trying to acquire all of DP&L. The USDA still gets its' 5% of any net sales of seeds though.
