I think the seed may be saved by individuals but it may not be propagated for sale. There are plant varieties bearing the PVP suffix and this may be such. I know the pepper variety "Jupiter" is so classified. I don't think that is a problem. The USDA has just come up with the equivalent of patenting new open pollinated varieties for a period of time and it seems just to compensate those who do this work. As long as the seed eventually returns to the public domain there is valid reason for protecting the original breeder.
