The ban on shellfish harvesting during certain months of the year (which
varies from state to state and on what type of shellfish) is generally to
reduce over fishing and reduce disruption of the beds during the shellfish's
reproductive phase, and has nothing to do with toxicity.  Many shellfish are
also less plump and flavorful during the reproductive phase.  The increase
in cases of food poisoning from shellfish is believed to be primarily due to
increased pollution, as well as changes in salinity and rising water
temperatures associated with increase rainwater runoff from developed areas.
There are also a number of less well understood factors involved.
